הודעה בדבר אישור תובענה ייצוגית
ת"צ (מרכז) 45354-02-18 חיים הירשפלד נ) Traveljigsaw Rentalcars) בהתאם להוראות סעיף 25(א)(1) לחוק תובענות ייצוגיות, התשס"ו-2006 (להלן: "החוק") מובא בזאת לידיעת הציבור כי בתאריך 9.3.2025 אישר בית המשפט המחוזי (מרכז) בישראל בקשה לאישור תובענה כייצוגית שהוגשה בישראל במסגרת ת"צ (מרכז) 45354-02-18 חיים הירשפלד נ' Traveljigsaw (להלן בהתאמה: "ההחלטה" ו-"המשיבה"). אלו עיקרי ההחלטה: הקבוצה שבשמה תנוהל התובענה: "כל ציבור הלקוחות הישראליים שהתקשרו בהסכם להשכרת רכב, באמצעות המשיבה, ואשרpite会议精神 את מלוא דמי השכרת הרכב מראש, ולא קיבלו את הרכב השכור המוזמן או רכב חלופי מתאים מחברה ההשכרה, עקב אי הגעה לאיסוף הרכב בשעה הנקובה בהזמנה." (להלן: "הקבוצה").
- הקבוצה שבשמה תנוהל התובענה: "כל ציבור הלקוחות הישראליים שהתקשרו בהסכם להשכרת רכב, באמצעות המשיבה, ואשר למרות ששילמו את מלוא דמי השכרת הרכב מראש, לא קיבלו את הרכב השכור המוזמן או רכב חלופי מתאים מחברת ההשכרה, עקב אי הגעה לאיסוף הרכב בשעה הנקובה בהזמנה." (להלן: "הקבוצה").
- התובעymiizg: עו"ד חיים הירשפלד.
- באי כוח התובעymiizg: עוה"ד שוקי אליוביץ וזיו זייטלבך וכן עוה"ד אברהם ניזרי ויוסי רייטר.
- עילות התביעה הנטענות בגינן אושרה התובענה כייצוגית: הטעיה לפי חוק הגנת הצרכן; רשלנות לפי סעיף 35 לפקודת הנזיקין; עשיית עושר ולא במשפט לפי סעיף 1 לחוק עשיית עושר ולא במשפט; הפרת חובות אמון וגילוי מכוח חוק השליחות; קיומם של תנאים מקפחים בניגוד להוראות חוק החוזים האחידים.
- הסעד הנתבע: מתן צווים כמפורט בתביעה; פיצוי כספי בגין הנזקים שנגרמו לחברי הקבוצה; השבת ההתעשרות.
- שאלות משותפות של עובדה ומשפט: האם מערך ההסכמים המהווים את בסיס ההתקשרות בין לקוחות המשיבה המזמינים באמצעותה רכב שכור כוללים סעיפים מטעים, מקפחים. האם המשיבה מטעה את לקוחותיה בכול הקשור לתנאי איסוף הרכב המושכר. האם המשיבה מתעשרת שלא במשפט על חשבון לקוחותיה. האם המשיבה מפרה חובות אמון וגילוי כלפי לקוחותיה.
בהתאם לסעיף 11(א) לחוק תובענות ייצוגיות, כל חבר קבוצה רשאי להודיע לבית המשפט בתוך 45 ימים מיום פרסום הודעה זו על רצונו שלא להיכלל בקבוצה.

Having a different drop off location to your pick-up location in Italy is certainly doable. The one exception is if you want to take your car from the Italian mainland to the island of Sardinia. Very few car hire companies will allow you to make this trip, since sea transport is involved.
You should also bear in mind that if you want to do a one-way rental, car hire companies will usually charge a One Way Fee, also known as a drop charge.

20 is a pretty common minimum age, although it depends on what kind of car you want.
You might need to be 25 to hire a big, powerful car, but since we work with so many companies in Italy, we can almost certainly find you a car you’ll be happy with, as long as you’re 20 or over.
There’s a box in the search form at the top of this page that says ‘Driver aged 30 – 65?’ If you’re under 30, uncheck that box and enter your age. When you hit ‘Search’, you’ll only see cars that someone your age can drive.
Top tip: Car hire companies might charge you a Young Driver Fee if you’re only a few years over the minimum age. These fees can really vary, so it’s well worth taking a bit of time to compare different cars and companies on our site. If you don’t see a Young Driver Fee underneath the car’s price, you’ll find it in the car’s terms and conditions (click ‘Ts&Cs’ and look under ‘Driving Charges’).
